Why Mediation?

What Is Private Mediation (Not the Same as Court-Ordered CCRC)

In California, there are two distinct paths that sometimes get confused:

  • “Public mediation”, now often referred to as CCRC (Custody Recommendation Counseling, which only handles custody/child-related matters when ordered by the court.
  • Private mediation, what we do. This is a voluntary process where a neutral third party (mediator or attorney-mediator) helps both sides negotiate all issues: property, support, custody, assets, and more.

We focus on private mediation to give couples a flexible, confidential, and collaborative setting, not a rigid, one-size-fits-all courtroom approach.

How Our Mediation Process Works

  1. Initial call or consultation – We discuss whether mediation fits your situation, explain the process, and answer your questions.

  2. Preparation & paperwork – You receive forms and a packet to complete financial disclosures and issue summaries to ensure clarity for both parties. 

  3. Joint mediation session – You and your spouse meet with a neutral mediator/attorney who helps you negotiate terms in a respectful, structured environment.

  4. Agreement drafting & review – If terms are agreed upon, we prepare a written settlement for review. Both parties get time to review before signing.

  5. Finalization & filing (if applicable) – Once signed, we assist with formalizing the agreement so it’s enforceable under California law.

Because mediation is less formal and more collaborative, many cases are resolved faster and more affordably than through litigation.

When Mediation Is Most Effective

Mediation tends to work best when:

  • Both parties want to avoid drawn-out court battles
  • There is mutual respect or willingness to cooperate
  • You want to maintain privacy and reduce conflict (especially helpful with children involved)
  • You want flexibility in scheduling, terms, and creative outcomes (custom property division, unique parenting plans, tailored support terms, etc.)

What Does the Mediator Do?

  • Offer ideas to solve the problem
  • Explains what the law is
  • Make predictions on what would occur if the issue was brought to court and litigated
  • Helps the parties think outside the box for creative solutions
  • Find out what each party really wants and what matters most and help craft solutions to get to the “heart” of each parties’ true desires.
  • Keep the peace between the parties
  • Answer legal questions that either party may have without advocating for either party

What Does the Mediator Not Do?

  • Advise either party on what they should agree to or not agree to
  • Advocate for either party
  • Take sides – the mediator gains nothing from taking sides

How Long Does the Process Take?

Assuming the parties sign the documents timely and respond to any inquiries timely a general estimate would be approximately 90 days from the initial mediation appointment to finalization of the Judgment. The same time frame exists as to the six month cooling off period.
